This Copyright, Intellectual Property, and Rights Complaints Policy explains how rights-related complaints are handled when content is made available through Valvibe.com and the related digital content service made available through that website, referred to in this Policy as the “Service.”
The Service is operated and administered by Wild SARL, a company registered in Luxembourg under registration number B232882, with its registered office at 10A rue des Mérovingiens, 8070 Bertrange, Luxembourg.
In this Policy, “Valvibe,” “we,” “us,” and “our” refer to Wild SARL.
Valvibe respects intellectual property rights. Content made available through the Service is made available based on Valvibe’s ownership, licenses, permissions, contractual warranties, or other authorizations obtained from content providers, licensors, and other relevant parties. We require content providers, licensors, and other relevant parties who provide content for the Service to confirm that they have the rights, licenses, consents, releases, and permissions needed for that content.
This Policy should be read together with our Terms of Service, and any other policy or notice that applies to the Service.
This Policy applies to complaints concerning content made available through the Service that is alleged to infringe copyright, trademark rights, image rights, publicity rights, privacy rights, or other intellectual property or related rights.
This Policy does not create any direct contractual relationship between customers and content providers. Content made available through the Service is selected, licensed, or otherwise authorized for use by Valvibe or its licensors.
If you believe that content made available through the Service infringes your copyright, trademark, image rights, publicity rights, privacy rights, or other rights, you may submit a notice to us.
Your notice should include:
(a) identification of the work, rights, material, image, likeness, trademark, or other protected matter that you claim has been infringed;
(b) identification of the content on the Service that you believe is infringing, including enough information for us to locate it;
(c) your name, email address, mailing address, and, where available, telephone number;
(d) a statement explaining why you believe the use of the content is unauthorized or unlawful;
(e) a statement that the information in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder; and
(f) your physical or electronic signature.
Incomplete notices may not be processed if we do not have enough information to identify the relevant content, understand the claim, or contact the person submitting the notice.
We may review notices and take action where required or appropriate, including investigating the relevant content, requesting additional information, contacting relevant parties, removing content, disabling access to content, restricting content, or taking other action permitted by law or our Terms of Service.
Content removal, restriction, or investigation does not constitute an admission of infringement, liability, or wrongdoing.
False, misleading, abusive, or bad-faith notices may be rejected and, where applicable, may result in account restrictions, suspension, termination, or other action permitted by law or our Terms of Service.
You may be responsible for damages, costs, or legal consequences if you knowingly submit a false or misleading claim.
Where we determine that content made available through the Service may infringe third-party rights, may be inconsistent with this Policy, or gives rise to serious or repeated rights-related concerns, we may take appropriate action.
This may include investigating the matter, requesting additional information or rights documentation, removing or restricting access to content, suspending or permanently discontinuing use of the relevant content, withholding the content from publication or promotion, ending or restricting a content licensing, promotional, or commercial relationship, withholding or adjusting amounts where permitted by contract, exercising contractual rights or remedies, and taking any other action permitted by law or contract.
Where appropriate, we may also cooperate with rights holders, service providers, payment processors, professional advisers, regulators, law enforcement authorities, courts, or other competent parties in connection with rights-related complaints, disputes, investigations, or legal claims.
Nothing in this Policy limits any rights or remedies available under applicable law.
We may handle copyright, trademark, image rights, privacy rights, publicity rights, or other rights-related complaints in accordance with applicable laws, contractual obligations, payment processor requirements, risk-management considerations, and our Terms of Service.
We may update this Policy from time to time to reflect changes to the Service, our review processes, legal requirements, or operational practices.
Where required by applicable law, or where changes are material, we may notify you by email, through the Service, by posting a notice, or by other appropriate means.
The updated Policy will apply when it is made available through the Service, unless otherwise required by applicable law.
